Terms of Service

1. Acceptance

By accessing or using TryoutScout ("the Service"), operated by TryoutScout LLC ("we," "us," or "Company"), you agree to be bound by these Terms of Service ("Terms"). If you are creating an account on behalf of a sports organization, club, or program, you represent and warrant that you have full authority to bind that organization to these Terms. If you do not agree, do not access or use the Service.

2. Description of Service

TryoutScout is a youth sports management platform that enables sports clubs and programs to manage tryout registrations, coach invitations, athlete evaluations, roster decisions, Individual Development Plans (IDPs), athlete and coach self-reflections, match and session notes, attendance tracking, team calendar events, game day planning, and parent and athlete portal access. The Service supports multiple user roles including club directors (owners), coaches, athletes, and parents/guardians.

TryoutScout is a technology platform and software tool only. We do not provide athletic coaching, scouting, evaluation, or advisory services of any kind. All evaluations, development plans, roster decisions, and athlete assessments are created by and are the sole responsibility of the club and its coaches.

3. Account Requirements and Eligibility

Director and coach accounts require users to be at least 18 years of age. Parent and guardian accounts require users to be at least 18. Athlete accounts may be created for minors only with verifiable parental or guardian consent collected at registration. You are responsible for: (a) maintaining the confidentiality of your login credentials; (b) all activity that occurs under your account; and (c) notifying us immediately at support@tryoutscout.com of any unauthorized access.

4. Club and Organization Responsibilities

Organizations and clubs using TryoutScout are solely responsible for:

  • Obtaining appropriate written consent from parents or guardians before submitting registration or evaluation data for any minor athlete.
  • All roster decisions, tryout outcomes, team selections, and athletic assessments made using or informed by data within the platform. TryoutScout does not make, recommend, or influence roster or selection decisions.
  • The accuracy, completeness, and lawfulness of all data entered into the platform, including coach notes, evaluation scores, match reflections, IDP content, attendance records, and athlete self-reflection content.
  • Ensuring all coach notes, evaluations, reflections, and communications comply with applicable federal, state, and local laws, including anti-discrimination laws.
  • Communicating their own privacy policies, tryout policies, and refund policies to athletes and families.
  • Ensuring athletes and parents have been informed that their data is being managed through the TryoutScout platform.
  • Any use of exported data (CSV or otherwise) outside the platform.

Clubs acknowledge that TryoutScout is a data processor acting on their instructions. The club is the data controller for all athlete and family data it inputs into the platform.

5. Data Ownership and License

You retain ownership of all data your organization inputs into the Service, including athlete registrations, evaluations, IDP content, coach notes, reflections, and roster decisions ("Club Data"). By using the Service, you grant TryoutScout LLC a limited, non-exclusive, worldwide license to store, process, and display Club Data solely as necessary to provide and improve the Service. We do not sell Club Data or share it with third parties for any commercial purpose outside of service delivery.

TryoutScout retains ownership of the platform, software, interfaces, algorithms, and all non-Club-Data content. Nothing in these Terms transfers any intellectual property rights in the platform to you.

6. Payments and Subscriptions

Paid plans are billed on a monthly or annual basis via Stripe. Subscriptions auto-renew at the end of each billing period until canceled. Canceling a subscription stops future charges but does not entitle you to a refund for the current billing period. Free plan accounts are subject to session and prospect limits; exceeding limits requires upgrading to a paid plan. We reserve the right to change pricing with at least 30 days' written notice. Custom "Club" tier pricing and terms are governed by a separate written agreement signed between TryoutScout LLC and the organization.

7. AI-Assisted Features

Certain Service features use artificial intelligence or machine learning to assist coaches and directors with evaluation summaries, development plan suggestions, or player insights ("AI Features"). You acknowledge and agree that:

  • AI Features provide suggestions only. They are not professional athletic assessments, medical evaluations, or expert opinions of any kind.
  • All AI-generated output must be reviewed and verified by qualified club staff before being used for any decision.
  • TryoutScout makes no warranty regarding the accuracy, completeness, or fitness of any AI-generated content.
  • You are solely responsible for any decisions made based on AI Feature output.

8. Children's Privacy (COPPA)

TryoutScout does not knowingly collect personal information directly from children under 13 without verifiable parental consent. For athletes under 13, all platform access is managed through the parent or guardian portal — no direct account is created for the child. Clubs are responsible for ensuring that parental consent is obtained before submitting any minor's registration, evaluation, or development data to the platform. Parents may contact us at privacy@tryoutscout.com to request deletion of their child's data.

9. Acceptable Use

You may not use the Service to:

  • Harass, discriminate against, or defame athletes, families, or coaches based on any protected characteristic.
  • Enter false, fabricated, or misleading evaluation data or coach notes about any athlete.
  • Share, sell, or transfer another organization's athlete data outside the platform without express written consent.
  • Reverse-engineer, copy, or create derivative works of any part of the platform.
  • Use the platform to make unlawful decisions regarding minor athletes.
  • Violate any applicable federal, state, or local law.

We may suspend or terminate accounts that violate these Terms without prior notice.

10. Service Availability and Modifications

We provide the Service on an "as available" basis. We do not guarantee uninterrupted or error-free access. We reserve the right to modify, suspend, or discontinue any feature or the entire Service at any time with reasonable notice where practicable. We are not liable for any interruption, delay, or unavailability of the Service.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. TRYOUTSCOUT DOES NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR THAT IT WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TRYOUTSCOUT LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING BUT NOT LIMITED TO DAMAGES ARISING FROM ROSTER DECISIONS, ATHLETE EVALUATIONS, DATA LOSS, OR RELIANCE ON AI-GENERATED CONTENT. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to defend, indemnify, and hold harmless TryoutScout LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your violation of these Terms; (c) any data you submit to the platform, including athlete evaluations, coach notes, or IDP content; (d) any roster or athlete selection decision made using the platform; or (e) your violation of any third-party right, including any privacy or intellectual property right.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles. Any dispute arising from or relating to these Terms or the Service shall first be submitted to good-faith negotiation. If unresolved, disputes shall be resolved exclusively in the state or federal courts located in Arizona, and you consent to the personal jurisdiction of such courts.

15. Changes to These Terms

We may update these Terms from time to time. We will provide at least 14 days' notice of material changes via email or a prominent notice in the Service. Continued use of the Service after the effective date of updated Terms constitutes acceptance.
